These Terms of Service ("Terms") govern your use of our sites — prospectmotorsports.com, wiendure.com, heroridealong.com, and friends.prospectmotorsports.com (each, a "Site") — operated by Prospect Motorsports Group ("PMG," "we," "us," or "our"). By using any Site, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility
You must be at least 18 years old to use our sites, submit a form, sign up as a participant, make or pledge a donation, or opt in to text messages. By using our sites or submitting any form, you confirm that you are 18 or older.
Use of the Site
You may use the Site to learn about PMG, our racing program, our partners, and our services. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site.
Intellectual Property
The Site and its content — including text, graphics, logos, images, photographs, videos, trademarks, and software — are the property of Prospect Motorsports Group or our licensors, and are protected by United States copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, or create derivative works from any Site content without our prior written consent, except for the limited purpose of viewing the Site for your personal, non-commercial use.
The "Prospect Motorsports Group" name, the PMG shield and monogram, the "WI Endure" name and wordmark, and related marks are trademarks of PMG. Use of these marks without our written consent is prohibited.
Submissions
If you submit information to us through the Site — including through contact forms, email, or social media — you represent that the information is accurate, that you have the right to submit it, and that it does not violate the rights of any third party. We may use any non-personal information you submit for any lawful business purpose.
Third-Party Links
The Site contains links to third-party websites, including our partner sites and the websites of our agency and paddock partners. These links are provided for your convenience. We do not endorse, control, or take responsibility for the content, policies, or practices of any third-party site. Accessing those sites is at your own risk.
Disclaimers
The Site and all content, products, and services available through the Site are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, PMG disclaims all warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of Liability
To the fullest extent permitted by law, PMG, its owners, officers, employees, agents, and partners will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, or property damage, arising from or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed one hundred United States dollars (USD $100.00).
Indemnification
You agree to defend, indemnify, and hold harmless Prospect Motorsports Group and its owners, officers, employees, agents, and partners from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
Participation in Programs and Events
Nothing on the Site constitutes an offer to sell, a binding commitment, or an enforceable agreement. Any participation in PMG's racing program, partnerships, sponsorships, charity fundraising events, or on-track activities is subject to separate written agreements, waivers, and releases that must be signed before participation. On-track activities carry inherent risks, and participants assume those risks as described in the applicable agreements. All participants, riders and drivers must be 18 or older.
SMS Program Terms
- Age requirement: You must be 18 or older to opt in to text messages.
- Program: Hero Ride Along text updates from Prospect Motorsports Group.
- Description: Participants who opt in on the sign-up form at heroridealong.com receive fundraising reminders, progress updates, round deadlines and ride scheduling. Participants who separately opt in to offers receive occasional offers and event invitations.
- Frequency: Message frequency varies.
- Cost: Message and data rates may apply.
- Opt out: Reply STOP to cancel at any time. You'll get one confirmation message and no further texts.
- Help: Reply HELP, or contact nick@prospectmotorsports.com or (608) 792-6651.
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive texts is not a condition of participating or donating.

Governing Law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-law principles. You agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Wisconsin, and you consent to the jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
